Types of Workers’ Compensation Benefits

New Jersey workers’ compensation laws provide for the following benefits:

• Medical benefits: Your medical needs are covered by workers’ compensation law provided that they are necessary and reasonable. This includes doctor visits, medications, surgeries, physical therapy and other needs arising from your workplace accident.
• Temporary total benefits: If your on-the-job accident is severe enough that you are unable to work for more than seven days, you are entitled to receive temporary total disability benefits. The amount you will receive is 70% of your average weekly wage, provided this amount does not exceed or fall below maximum and minimum rates set by the state. Payments will continue until you return to work or attain maximum medical improvement. If neither of these occurs, payment will stop after 400 days.
• Permanent partial benefits: When a job-related injury or illness results in a permanent bodily impairment, benefits are based on the individual’s functional loss. These benefits are paid weekly and are due once temporary disability ends.
• Permanent total benefits: These benefits are paid to workers who are no longer able to engage in any type of gainful employment due to a workplace injury. Benefits last for 450 weeks but may continue beyond that time limit if the injured worker remains disabled and unable to perform work duties.
• Death benefits: If you have lost a loved one in a fatal workplace accident, you are entitled to receive death benefits, which include 70% of your family member’s average weekly wage as well as reasonable funeral and burial expenses.

Steps You Should Take After An Accident

Many people aren’t sure what to do after an accident. The first thing you should do is report the incident to your manager.
